Former IEBC chairman Wafula Chebukati will lose, according to attorney Danstan Omari, if he chooses to sue Azimio leader Raila Odinga.
Omari claimed the defences against defamation revolve around proof, justification, and public office during an interview with NTV on Wednesday.
“Chebukati was holding a public office. Based on that, anybody will tell him whatever he wants to be told. No court is going to award him anything,” he said.
“If he’ll be given damages, he will be given nominal damages of ‘one’ or ‘two’ shillings, “
He argued that Chebukati could only file a slander lawsuit if he was in a private office.
“These are the realities of the law. That matter is playing into the hands of Azimio,” he said.
Omari stated that the Azimio team will respond to Chebukati’s letter in court in regards to a response.
“They have given seven days. Six days remaining. Let them file the matter. We will respond appropriately in court and we will produce that evidence,”.
His comments come a day after Raila received a demand letter from Chebukati’s attorney Steve Ogolla requesting the release of video evidence of the former chairman’s visit to his residence within seven days.
